The Argument

The entire process takes months. It requires literacy, persistence, medical knowledge, and often legal representation. For a denial that took 1.2 seconds.
This is the Procedural Attrition Gate. Not a flawed algorithm. Not a biased dataset. A temporal architecture in which the speed of denial and the friction of appeal combine to produce a system that is structurally immune to correction at scale.
The Appeal Paradox
The numbers reveal an extraordinary paradox. Across major health insurers, fewer than 0.2% of denied claims are appealed. Healthcare. Beyond the Cigna and UnitedHealth cases, the Optum algorithm — used to guide care decisions for approximately 200 million people annually — was found in 2019 to systematically reduce care recommendations for Black patients by over 50%. The algorithm used healthcare spending as a proxy for healthcare need, and because Black patients historically spent less on healthcare (due to barriers including insurance coverage gaps, geographic access limitations, and discrimination), the algorithm interpreted their lower spending as lower need. Housing. SafeRent, a tenant screening algorithm used by landlords across the United States, was the subject of a $2.2 million settlement in 2024 after a federal investigation found it discriminated against Black and Hispanic renters and housing voucher holders. Applicants who were rejected based on their SafeRent Score typically received no meaningful explanation of the score’s basis, no information about which data points drove the rejection, and no practical mechanism for contest. The Center for Digital Technology found that algorithmic tenant screening enables racial and disability discrimination at scale by compounding historical disparities in arrest records, credit histories, and eviction filings — data categories that reflect systemic inequalities rather than individual tenancy risk. [Measured] [6] Academic research confirms that credit-based screening compounds exclusion for housing voucher holders, creating a secondary gate that undermines the anti-poverty purpose of the vouchers themselves. Public Benefits. In 2024, a federal judge ruled that a $400 million algorithmic system used to determine Medicaid eligibility had illegally denied benefits to thousands of people. [Measured] [9] During the post-pandemic Medicaid unwinding, approximately 25 million people lost coverage, the majority due to paperwork failures rather than actual ineligibility. The affected individuals — disproportionately low-income, disproportionately people of color, disproportionately those with limited English proficiency — faced a contest process that required them to obtain, complete, and submit documentation within tight deadlines, navigate automated phone trees, and appear at administrative hearings during business hours.
Australia’s Robodebt program provides the most devastating case study. Between 2016 and 2020, the Australian government used an automated income-averaging algorithm to generate debt notices against welfare recipients. The system compared annual income data from the tax office with fortnightly welfare payments, assumed income was earned uniformly throughout the year, and flagged any discrepancy as overpayment. The algorithm was wrong by design — income is not earned uniformly, and the averaging method systematically generated false debts. The government raised $1.2 billion in automated debt notices before a Royal Commission found the scheme unlawful from inception. Robodebt illustrates that the attrition gate operates in public systems as well as private ones, but through different causal pathways. In private systems — healthcare insurers, tenant screening companies — the profit motive drives denial throughput: every denied claim is a cost saved, every rejected tenant is a risk avoided. US-Centrism and the Public/Private Distinction
The evidence presented here is overwhelmingly drawn from US-based systems operating in privatized service delivery contexts — health insurance, tenant screening, consumer credit. This is a real limitation. The profit motive in private systems creates a specific incentive structure: every denied claim is revenue retained, and the attrition gate directly serves the bottom line.
Public systems operate under different incentives. Australia’s Robodebt was driven by fiscal austerity, not shareholder returns. The UK’s Universal Credit automated adjustments serve budget targets, not profit margins. The architecture is the same — machine-speed decisions with human-speed appeals — but the causal pathway differs. Private systems deploy the attrition gate because denial is profitable. What Would Change Our Mind
